Disability tax reduction cannot be applied if self-employed taxi activity continues

A taxi driver with a permanent disability inquired whether they could reduce the capital gains tax resulting from the sale of their licence. The DGT ruled that if the activity continues following the disability, the transfer is not considered to be motivated by such cause, and therefore the reduction does not apply.

Cuestión planteada Si podría acogerse a la reducción de la ganancia patrimonial prevista en la disposición adicional séptima de la Ley sobre la Renta de las Personas Físicas.

The DGT's ruling

La reducción de la ganancia patrimonial por transmisión de activos intangibles (licencias) requiere que el contribuyente use el método de estimación objetiva. Además, la transmisión debe estar motivada por incapacidad permanente, jubilación o cese por reestructuración, o bien transmitirse a familiares hasta segundo grado. Si el taxista continúa la actividad tras la incapacidad, la venta posterior no se considera motivada por la incapacidad, sino por el cese de actividad, perdiendo el beneficio fiscal.
