The discount applicable is that in force on the date of death, not the new ordinance

The inquirer asks whether a 40% or 95% discount should be applied to the IIVTNU following a change in the local ordinance. The Treasury responds that the regulations in force at the time the tax liability arises—the date of death—must be applied.

Cuestión planteada Si todavía no se ha liquidado el impuesto, ¿qué porcentaje de bonificación le corresponde, el 40 o el 95 por ciento?

The DGT's ruling

El devengo del IIVTNU por transmisión mortis causa se produce en la fecha del fallecimiento del causante. Las normas aplicables a la liquidación son las vigentes en el momento del devengo. Por tanto, la bonificación aplicable es la que estaba en vigor en la fecha del fallecimiento, sin efectos retroactivos de la nueva ordenanza.
