Acquisition value for Personal Income Tax may be the value verified by the Autonomous Community

The inquirer asks which acquisition value should be used to calculate capital gains on a property that underwent a value verification process by the Autonomous Community in 2008. The DGT responds that, depending on whether the acquisition was onerous or gratuitous, the value verified by the administration shall apply.

The question raised

Acquisition value of the real estate for the purpose of calculating the capital gain in Personal Income Tax.

The DGT's ruling

If the acquisition was onerous and the Transfer Tax was verified, the verified value shall be the actual amount for Personal Income Tax purposes. In the case of acquisition by inheritance, the acquisition value shall be the declared value or the value verified for Inheritance and Gift Tax purposes, plus the inherent expenses and taxes. If the verification resulted in a value higher than the declared one, this shall be the value taken into account to calculate the capital gain or loss.
