Deduction for principal residence may apply when investment exceeds previous residence amount

A taxpayer inquired whether they could claim the deduction for investment in their principal residence after acquiring a home before 2013, but having not used it previously because the investment did not exceed that of their former residence. The Directorate General for Taxes (DGT) ruled that it is possible to claim the deduction in the tax year in which such amounts are exceeded.

The question raised

Possible application of the deduction for investment in the primary residence from the moment the investment in the current primary residence exceeds the investment made in the previous one.

The DGT's ruling

Taxpayers who acquired their residence before 2013 may access the transitional regime if they have already claimed the deduction for previous residences. They may also access it if they did not claim it because the amounts invested did not exceed those of previous residences subject to deduction. In the first fiscal year in which those amounts are exceeded, they shall be entitled to the deduction provided they meet the remaining requirements.
