Contributing separate property to a community property regime may trigger capital gains or losses for Income Tax purposes

The inquirer asks about Income Tax (IRPF) implications when contributing a privately owned property to a community property regime and subsequently donating said property. The Directorate General for Taxes (DGT) rules that the contribution triggers a capital gain or loss on half of the asset's value, as ownership is attributed 50% to each spouse.

The question raised

Taxation under Personal Income Tax (IRPF) regarding the contribution to the community property regime and the subsequent donation of the real estate property by the taxpayer.

The DGT's ruling

The gratuitous contribution of a separate asset to the community property regime constitutes an asset alteration that generates a capital gain or loss for 50% of the asset, as ownership is attributed equally to each spouse. The subsequent donation of that half will also generate a capital gain or loss. In both cases, if a capital loss occurs through lucrative transfers, it shall not be computable. Gains shall be included in the savings tax base.
