Reference catastral value must be declared if higher than inherited value

A taxpayer asks whether the market value of an inherited property can be adjusted. The DGT responds that a supplementary self-assessment must be filed using the catastral reference value, as the declared value was lower.

Question raised: Whether it is possible to rectify the valuation of the inherited property to align it with the economic reality.

The DGT's ruling

The tax base of a property is the Cadastre reference value, unless the value declared by the interested parties is higher. If the declared value is lower than the reference value, a supplementary self-assessment must be filed with the amount of the reference value. It is not possible to declare a value higher than the reference value in the supplementary assessment if the value initially declared did not exceed said limit.
