Property acquisition value to be the value verified by the Autonomous Community following a review

A taxpayer inquired which value should be used to calculate capital gains on a property after the Community of Madrid conducted a value verification. The Directorate General of Taxes (DGT) ruled that the verified value must be applied.

The question raised

The acquisition value that must be assigned to the real estate for Personal Income Tax purposes for the calculation of the capital gain or loss that would be obtained in its future sale.

The DGT's ruling

The acquisition value is composed of the actual purchase amount plus inherent expenses, investments, and taxes. However, according to the jurisprudence of the Supreme Court, if there is a verification of values by the Autonomous Community for the Transfer Tax, the acquisition value shall be the verified value.
