Segregated plots retain the value and acquisition date of the parent property

A taxpayer inquired about calculating capital gains or losses when selling a property and subsequently selling the plots resulting from a subdivision. The Directorate General for Taxes (DGT) ruled that subdivision does not alter the asset's identity and that the acquisition value of the plots shall be that of the original property.

The DGT's ruling

La segregación de fincas no supone una alteración patrimonial, por lo que las fincas resultantes mantienen el mismo valor y fecha de adquisición que la finca matriz. La ganancia o pérdida patrimonial se calculará por la diferencia entre los valores de transmisión y adquisición según los artículos 35 y 36 de la LIRPF. Los intereses de préstamos hipotecarios no forman parte del valor de adquisición.
