Joint ownership of an 'indistinct' account does not determine money ownership and may be subject to inheritance tax

The inquirer asks whether they must pay tax on 50% of the balance of current accounts following their mother's death, given these accounts are jointly held. The DGT responds that the authority to dispose of funds is not the same as legal ownership, and that the origin of the funds will determine whether inheritance tax is applicable.

The DGT's ruling

La cotitularidad en cuentas indistintas solo otorga facultades de disposición frente al banco, pero no presume la propiedad o condominio del saldo. La titularidad dominical depende de la pertenencia originaria de los fondos y debe probarse fehacientemente. Tras el fallecimiento de un cotitular, la parte que pertenecía al causante debe integrarse en su caudal relicto. Si se acredita que los fondos eran exclusivamente de la madre, el heredero deberá tributar por el Impuesto sobre Sucesiones y Donaciones.
