Taxation depends on tax residence; treaty with the Netherlands provides for exemption with progression

A worker who resided in the Netherlands and subsequently moved to Spain asks where they must declare income and how to avoid double taxation. The DGT explains that tax residence must first be determined; if the individual is a resident in Spain, income from the Netherlands may be exempt with progression under the Double Taxation Treaty.

The DGT's ruling

Si la consultante es residente fiscal en España, tributará por su renta mundial, pero las rentas del trabajo obtenidas en Holanda que puedan gravarse allí se eximirán en España mediante el método de exención con progresividad. Si no es residente fiscal en España, tributará por el IRNR únicamente por las rentas de fuente española. El conflicto de residencia se resuelve mediante las reglas del Convenio entre España y los Países Bajos.
