Reinvestment exemption for principal residence applies if the new home was acquired within two years prior to the sale

The applicant asks whether they can apply the reinvestment exemption after selling their principal residence and using the proceeds to pay off the mortgage of a home purchased previously. The DGT rules that the exemption is applicable if the new home was acquired within the two-year period preceding the transfer of the old one.

The question raised

Question posed: Whether the exemption for reinvestment in a primary residence is applicable.

The DGT's ruling

In order for the capital gain from the sale of the primary residence to be exempt, the amount obtained must be reinvested in the acquisition of a new primary residence. This acquisition may have been carried out within the period of two years prior to the transfer of the sold residence. The residence must meet the requirements of primary residence for both the transferred and the acquired property.
