Market value in company dissolution is the price agreed between independent parties

A company in the Valencian Community has requested clarification on whether expert valuations based on Generalitat Order 4/2014 are valid for calculating the tax base for Corporate Tax, Personal Income Tax, and Transfer Tax/Stamp Duty during liquidation. The DGT clarifies that for Corporate and Personal Income Tax, market value must be used, and for Transfer Tax, following said Order may result in the declared value being binding for the Tax Administration.
