Allocation of assets exceeding ownership share results in capital gain or loss upon dissolution of community property

A taxpayer inquired whether cash compensation received when extinguishing joint ownership of a property following a divorce is subject to Personal Income Tax (IRPF). The Directorate General for Taxes (DGT) ruled that the allocation of assets with a value exceeding the ownership share does constitute a capital alteration.
