Contributions to foreign companies for corporate operations are non-taxable, but real estate contributions incur Stamp Duty

A query was raised regarding whether the contribution of real estate and shares to a Maltese company is subject to Transfer Tax (ITP) and Stamp Duty (AJD). The DGT ruled that these do not qualify as corporate operations or onerous transfers; however, the contribution of real estate is subject to Stamp Duty under the variable rate.
