No capital gains or losses shall be recognised on the donation of shares if the requirements of Art. 20.6 of the IHT and Gift Tax Act are met

Retired parents enquired whether donating shares in their company to their son would exempt them from paying capital gains tax under Personal Income Tax (IRPF). The Directorate General for Taxes (DGT) ruled that the absence of a capital gain applies provided the requirements of Article 20.6 of the Inheritance and Gift Tax Act are satisfied.
