Novation of a leasing agreement with reduced instalments is not subject to Stamp Duty on the variable component

A query was raised regarding whether the novation of a financial leasing agreement that reduces the interest rate is subject to Stamp Duty (AJD) on the variable component of notarised documents. The Directorate General for Taxes (DGT) ruled that, as the instalments are reduced, there is no increase in the taxable value that would trigger the tax.
