Reinvestment exemption does not apply to the sale of a second garage space acquired later

A taxpayer inquired whether the sale of their primary residence along with two garage spaces qualifies for the reinvestment exemption. The DGT ruled that only the garage space acquired simultaneously with the residence is treated as part of the property, and the second space does not qualify for the exemption.

How it affects those involved

This ruling clarifies that for tax exemption purposes, only garage spaces acquired as part of the original purchase of the primary residence are considered assimilated assets. Subsequent acquisitions of parking spaces are treated as separate assets and do not benefit from the reinvestment relief.
