Properties registered as offices: change of use to residential required for tourist rental registration number

The Directorate General for Legal Certainty and Public Faith has dismissed an appeal against the suspension of the assignment of a unique tourist rental registration number. The resolution confirms that if a property is listed in the Land Registry as a "professional office", it is mandatory to first register a change of use to "residential" in order to operate as a short-term rental (Resolution of 11 December 2025).

In 2 key points

  1. Prior registration of the change of use to "residential" is required if the property is listed as a "professional office" (Resolución de 11 de diciembre de 2025)
  2. Two-month period to appeal via a claim before the Civil Court from the date of notification (art. 325 y 328 de la Ley Hipotecaria)

How it affects those involved

For owners of properties registered for professional office use, it is not possible to obtain a tourist rental licence without first completing the change of use to residential. This resolution reinforces the requirement that the physical reality and use of the property must strictly match its registry description to obtain tourist rental registration numbers.
