Tourist Use Housing (VUT): tourist accommodation activity does not necessarily imply a change of urban planning use to lodging

The Directorate General for Legal Certainty and Public Faith resolves an appeal against the suspension of a tourist rental registration number in Seville. The resolution establishes that Tourist Use Housing (VUT) constitutes a tourist accommodation service activity and not a change of urban planning use to lodging, allowing the dwelling to maintain its residential use while performing said activity (art. 4 and 6.5.1 of the specific amendment 44).

In 2 key points

  1. Tourist accommodation is classified as an activity rather than a land-use category for lodging purposes (art. 6.5.1)
  2. VUTs (Tourist Use of Housing) may maintain residential use while temporarily conducting tourist activities (art. 6.3.1)
