Owners of tourist accommodation: majority requirements and planning use for registration numbers

The Directorate General for Legal Certainty and Public Faith has upheld the suspension of the issuance of tourist rental registration numbers due to a lack of standing and failure to comply with planning regulations. It has been established that applications must be ratified by a simple majority of the property owners (Facts II) and that Tourist Use Dwellings cannot be considered a change of use to accommodation unless they are expressly categorised as such (Legal Grounds).

In 2 key points

  1. The application for a registration number must be made by a simple majority of the property owners (Facts II). (Hechos II)
  2. Tourist Use Dwellings are not categorised under 'Accommodation' use, thus retaining their residential use (Legal Grounds). (Fundamentos de Derecho)
