Tourist rentals in Madrid: municipal licence and regional registration required to obtain registration number

The Directorate General for Legal Certainty and Public Faith has rejected an application for a single registration number for short-term tourist rentals, as the applicant failed to provide proof of a Madrid municipal licence and registration in the Community of Madrid's Register of Tourist Businesses. To operate tourist accommodation in Madrid, both regional registration (Art. 17 Decree 79/2014) and a municipal licence (Art. 151.1 Law 9/2001 of the Community of Madrid) are mandatory.

In 3 key points

  1. Requirement to register with the Community of Madrid's Register of Tourist Businesses (Art. 17 Decree 79/2014). (art. 17 Decreto 79/2014)
  2. Mandatory municipal licence from the Madrid City Council (Art. 151.1 Law 9/2001). (art. 151.1 Ley 9/2001)
  3. Two-month deadline to appeal via a claim before the Civil Court from the date of notification (Art. 325 and 328 Mortgage Law). (art. 325 y 328 de la Ley Hipotecaria)

How it affects those involved

Owners or managers of tourist accommodation in Madrid will be unable to obtain the necessary registration identification for their activity unless they comply with the dual requirement: a licence from the Madrid City Council and registration with the Community of Madrid (Art. 17 Decree 79/2014 and Art. 151.1 Law 9/2001). Failure to meet these requirements prevents the assignment of a single registration number for short-term rentals.
