Industrial and mining companies: new application rules for EU Critical Raw Materials and Net-Zero Technologies regulations

Royal Decree 845/2026 establishes the national framework for implementing the EU Regulations on Critical Raw Materials (CRMA) and Net-Zero Technologies (NZIA). The regulation governs coordination between the General State Administration and the Autonomous Communities for managing strategic projects, designating single points of contact, and creating acceleration valleys and testing spaces (Chapters I and II). It aims to integrate these European guidelines with the Mining Law and the Waste and Contaminated Soils Law for a Circular Economy.

In 3 key points

  1. Autonomous Communities, Ceuta, and Melilla will designate single contact points for critical raw materials projects (Section 1 of Chapter I). (sección 1.ª del capítulo I)
  2. Acceleration valleys and controlled net-zero testing spaces are established under a defined competency framework (Articles 19 and 20). (art. 19 y 20)
  3. The Secretary of State for Industry will perform coordination functions for the declaration of strategic projects (Article 23). (art. 23)

How it affects those involved

For companies in the industrial and mining sectors, the regulation defines the competency structure and contact points for critical raw materials and net-zero technologies projects (Chapters I and II). Autonomous Communities must designate single contact points for raw materials projects (Section 1 of Chapter I). Companies operating in acceleration valleys or net-zero testing spaces will be subject to a specific administrative coordination framework to ensure consistency with the Spanish legal system (Articles 19 and 20).
