Prison officials and staff: recognition as agents of authority and right to compensation for damages

Organic Law 4/2026 amends Organic Law 1/1979 to formally recognize prison administration officials as agents of authority (art. 80.2). This reform grants evidentiary relevance to their reports in disciplinary proceedings and establishes the Administration's obligation to compensate for personal or material damages suffered during service, provided there is no willful misconduct, fault, or gross negligence (art. 80.5). This criminal protection and right to compensation are also extended to labor staff (art. 80.7).

  3. In force from 15 October 2026, the day following its publication (Second Final Provision). (disp. final segunda)

How it affects those involved

For the Administration, it entails the obligation to assume liability for damages suffered by its employees, except in cases of gross negligence by the worker (Art. 80.5).
