Gaming operators: 60 days to adapt gambling addiction warnings and minor protection messages in advertising

This resolution establishes mandatory technical specifications for warning messages in commercial communications for gambling activities. It replaces the 'play responsibly' message with one regarding the harmful effects of gambling addiction and unifies the message prohibiting participation by minors (Art. 10.4 and 11.4 RD 958/2020). Specifications for format, size, and contrast are detailed in Annexes I and II of the resolution.

In 3 key points

  1. Entry into force sixty days after publication in the BOE (Seventh Provision). (Disposición Séptima)
  2. 3-month period to execute advertising contracts signed before the resolution without adaptation (Sixth Provision). (Disposición Sexta)
  3. Exemption from gambling addiction messages for promotional contests on the radio (Fifth Provision). (Disposición Quinta)

How it affects those involved

Gaming operators must modify the design of their advertising materials to comply with the new text formats and graphic layouts (Annexes I and II). An exception is permitted for promotional contest communications on the radio (Fifth Provision). Advertising contracts already signed have a three-month grace period to continue being executed without changes (Sixth Provision).
