Waste management entities: public access to waste production and management registry information defined

This Order establishes the content of information that will be publicly accessible within the Waste Production and Management Registry, integrated into the eSIR system (Art. 63 Law 7/2022). The regulation aims to ensure waste transparency and traceability in compliance with Directive (EU) 2018/851, while ensuring the confidentiality of data protected as trade secrets (Art. 63 Law 7/2022).

In 2 key points

  1. The Waste Production and Management Registry will be incorporated into the Electronic Waste Information System (eSIR) (art. 63 Ley 7/2022)
  2. Confidentiality is guaranteed for data that may be considered a trade secret (art. 63 Ley 7/2022)

How it affects those involved

For entities (natural or legal persons) involved in the waste production and management chain, the regulation implies greater exposure of their activities through public consultation of their registry data (Art. 63 Law 7/2022). Companies must ensure that the information submitted to the Registry does not compromise trade secrets, as the regulation guarantees the protection of such data (Art. 63 Law 7/2022). Public administrations will be responsible for managing data interconnection and the publication of information in accordance with this framework.
