Public Administration: creation of a working group to study early retirement due to arduousness and gender

An inter-ministerial working group has been established to analyse the gender dimension and the arduousness of work performed by age (art. 1.1). The objective is to evaluate whether certain occupations with a higher female presence should benefit from reduction coefficients to advance the retirement age (first additional provision RD 402/2025). The group must prepare a report of conclusions, coordinated between the Labour Inspectorate and the National Institute for Safety and Health at Work (art. 4.3).

In 3 key points

  1. The timeframe for conducting the assessment on gender dimension and arduousness will be one year from the group's constitution (art. 3.4). (art. 3.4)
  2. The order enters into force on the day following its publication in the BOE (art. Seventh). (art. Séptimo)
  3. Possibility of initiating ex officio proceedings if there is no employer or trade union representation for the affected group (art. 3.5). (art. 3.5)

How it affects those involved

For female workers in arduous occupations or those with a high female presence, the regulation lays the groundwork for future reforms allowing earlier retirement through reduction coefficients (art. 1.1). For companies and trade unions, the group will assess the need to initiate ex officio proceedings if eligible groups are detected without representation (art. 3.5). The study has a maximum term of one year from its constitution (art. 3.4).
