Constitutional Court admits unconstitutionality challenge regarding Public Employment Act 20/2021

The Constitutional Court has admitted unconstitutionality challenge no. 5552-2026, which contests the validity of the sixth and eighth additional provisions of Law 20/2021 (BOE-A-2021-21651). The proceedings examine whether said regulation, aimed at reducing temporary employment in the public sector, violates Articles 23.2 and 149.1.18 of the Spanish Constitution. The Court has reserved the matter for its own consideration following a proposal from the 2nd Section of the Administrative Litigation Chamber of the High Court of Justice of Castilla-La Mancha.

In 2 key points

  1. Admission of unconstitutionality challenge no. 5552-2026 for processing (providencia de 22 de septiembre de 2026)
  2. 15-day deadline to appear if a party to ordinary proceeding no. 400-2022 (art. 37.2 LOTC)

How it affects those involved

For public administrations and workers subject to Law 20/2021, the admission of this challenge creates legal uncertainty regarding the validity of the law's sixth and eighth additional provisions. Parties already involved in ordinary proceeding no. 400-2022 have a 15-day period to appear before the Constitutional Court (Art. 37.2 LOTC).
