State and Balearic Islands agree to negotiate discrepancies regarding the Balearic Islands Ports Act

The Bilateral Commission for State-Balearic Islands Cooperation has agreed to begin negotiations to resolve discrepancies identified in Law 3/2026, which amends the autonomous community's port regulations. The agreement establishes the creation of a working group to propose technical solutions and will notify the Constitutional Court of this process (annex, points 1, 2, and 3).

In 3 key points

  1. Negotiations will begin to resolve discrepancies in sections 1, 4, 10, and 13 of the single article of Law 3/2026 (anexo, punto 1)
  2. A working group is appointed to propose solutions to the Bilateral Commission (anexo, punto 2)
  3. The agreement is communicated to the Constitutional Court in accordance with art. 33.2 of LO 2/1979 (anexo, punto 3)

How it affects those involved

For administrations (the State and the Autonomous Community), the agreement provides a political and technical resolution pathway to avoid a jurisdictional conflict before the Constitutional Court (annex, point 3). For port operators and sectors affected by Law 3/2026, the resolution of discrepancies in sections 1, 4, 10, and 13 of the single article will determine the legal certainty of local port regulations (annex, point 1).
