Driving schools: automatic cancellation of authorisation upon completion of vocational training is annulled

The Supreme Court has partially upheld the appeal filed by the CNMC against Royal Decree 1010/2023, declaring null and void a provision that extinguished the authorisation of vocational training centres upon the conclusion of their training activities (Second Ruling). This judgment invalidates the wording of Article 48 ter of the regulations governing private driving schools, which linked the validity of the authorisation to the end of training at said centre (Second Ruling).

In 2 key points

  1. Article 1. 21 of Royal Decree 1010/2023 regarding the extinction of authorisation is declared null (Second Ruling). (Fallo Segundo)
  2. The paragraph linking the validity of the authorisation to the end of training at the vocational training centre is invalidated (Second Ruling). (Fallo Segundo)

How it affects those involved

For driving schools operating as vocational training centres, the risk of automatic loss of administrative authorisation upon completion of their training cycles is eliminated (Second Ruling). Consequently, the CNMC has succeeded in preventing a potential restriction of competition or a barrier to entry/permanence based on the duration of vocational training (First Ruling).
