Audiovisual service providers: new self-regulation rules for content classification

The Corregulation Agreement for audiovisual programme and content classification is published under Article 98.2 of Law 13/2022 (LGCA). Signed by the CNMC, the Ministry of Digitalisation and various audiovisual operators, it establishes the framework for content classification and protection of minors. Its aim is to support compliance with information and visual descriptors obligations (Articles 97 and 98 LGCA).

In 2 key points

  1. The agreement establishes the self-regulation framework for content classification as provided in Article 98.2 of the LGCA. (art. 98.2 LGCA)
  2. The CNMC will supervise content appropriateness and compliance with self-regulation codes (Articles 9.14 and 9.16 LCNMC). (art. 9.14 y 9.16 LCNMC)

How it affects those involved

For audiovisual communication service providers (TV operators, streaming platforms and others), the agreement sets out self-regulation rules that the CNMC will supervise to ensure content appropriateness (Article 9 LGCA). Operators must adapt their content classification systems and visual descriptors to protect minors and provide adequate information to viewers (Article 97 LGCA). The CNMC assumes responsibility for monitoring compliance with these self-regulation codes (Articles 9.14 and 9.16 LCNMC).
