Denial of tourist rental registration number: requirement for successive chain of title and legible documents

The Directorate General for Legal Certainty and Public Faith is reviewing an appeal against the denial of a short-term rental registration number (NRU) for a property in Cazalegas. The Registrar denied the application for two reasons: the illegibility of the Secure Verification Code (CSV) of the Toledo Provincial Delegation's resolution and the failure to register the property in the applicant's name, which violates the principle of successive chain of title (Art. 20 of the Mortgage Law).

In 2 key points

  1. The lack of prior property registration prevents obtaining an NRU due to the principle of successive chain of title, Art. 20 of the Mortgage Law (art. 20 Ley Hipotecaria)
  2. Rectification must be completed within seven working days to avoid suspension of the registration number and disabling on platforms (art. 98 Reglamento Hipotecario)

How it affects those involved

For owners of tourist accommodation, obtaining a registration number (NRU) is strictly contingent upon compliance with the successive chain of title; a private sale agreement is insufficient to register rights without prior registered ownership (Art. 20 of the Mortgage Law). Furthermore, any error in the legibility of the Secure Verification Codes (CSV) of administrative resolutions prevents the entry of registry records. Failure to comply with rectification deadlines may result in the suspension of the registration number's validity and the disabling of advertisements on rental platforms (Art. 98 of the Mortgage Regulations).
