Ruling on registration suspension: Zafra Registrar suspends entry due to suspected concealment of changes to mortgageable entity

The Directorate General for Legal Certainty and Public Faith has ruled on an appeal against the suspension of a land registry entry in Zafra. The Registrar suspended the registration of changes to the area and boundaries of a property after detecting well-founded doubts that the intended increase in area concealed the aggregation of adjacent land (Art. 201.1 Mortgage Law). The case focuses on the discrepancy between the registry area, the cadastral area, and the area declared in the sale deed.

In 2 key points

  1. Suspension due to well-founded doubts regarding the concealment of changes to the mortgageable entity, Art. 201.1 Mortgage Law (art. 201.1 Ley Hipotecaria)
  2. Registry entries are protected by the Courts until their inaccuracy is declared, Art. 1.3 Mortgage Law (art. 1.3 Ley Hipotecaria)

How it affects those involved

For individuals and notaries, the ruling emphasises the Registrar's duty to suspend entries when there are doubts as to whether the rectification of a registry description conceals property transfers or modifications to the mortgageable entity (Art. 201.1 Mortgage Law). Public administrations and registrars retain the power to monitor the accuracy of provided measurements to prevent the irregular aggregation of properties.
