Owners of tourist rental properties: community authorisation required for registration number if licence is dated after 3 April

The Directorate General for Legal Certainty and Public Faith confirms that assigning a unique registration number for short-term tourist rentals requires certification of a favourable resolution from the Owners' Association, provided the tourist use licence was obtained after 3 April 2025. This resolution applies to cases where the most recent property transfer occurred after the licence was obtained, or where the licence itself post-dates the aforementioned deadline, in accordance with Organic Law 1/2025 (DF 4.ª).

In 3 key points

  1. Certification of a favourable resolution from the Owners' Association is required for the assignment of a registration number (Hechos y fundamentos de Derecho)
  2. The obligation arises if the tourist use licence is obtained after 3 April 2025 (Título oficial)
  3. A 60-day period to extend filing entries following communication (Parte dispositiva 3)

How it affects those involved

For owners of properties intended for tourist rental, obtaining a registration number is contingent upon the express approval of the owners' association in buildings where the tourist use licence was issued after 3 April 2025. This presents a risk of administrative deadlock for tourist activities if there is no consensus within the Association. Owners must submit the certification of the Association's resolution to rectify any unfavourable entries in the Land Registry.
