Social Security Legal Service elevated to Directorate-General status

Royal Decree 616/2026 amends the organisational structure of the Ministry of Inclusion, Social Security and Migration to elevate the rank of the Legal Service Directorate from sub-directorate general to Directorate-General (Art. 2.4 and additional provision 1 of RD 501/2024). This change addresses the complexity of its functions and the need to coordinate legal assistance across multiple ministerial departments, including Health and Social Rights, Consumer Affairs, and the 2030 Agenda.

In 2 key points

  1. The Legal Service Directorate moves from sub-directorate general level to Directorate-General level (art. 2.4 y disp. adicional 1 del RD 501/2024)
  2. The Legal Service provides assistance to the ministries of Inclusion, Health and Social Rights, Consumer Affairs, and the 2030 Agenda (texto fuente)

How it affects those involved

The regulation does not alter the rights of individuals or the obligations of companies, but rather modifies the internal structure of the Administration. For the Administration, it provides greater capacity for management and coordination of legal assistance in the face of digital challenges and highly complex matters. The Legal Service is attached to the State Secretariat for Social Security and Pensions with a higher organisational level to facilitate its intervention in matters of significant importance.
