Ruling on appeal against negative registry qualification: suspension of georeferencing registration due to objections from neighbours and local council

The Directorate General for Legal Certainty and Public Faith has ruled on an appeal against the decision of the Land Registrar of Huércal-Overa to withhold initiating the procedure under Article 199 of the Mortgage Law. The registrar suspended the registration of a property's georeferencing following objections from a neighbour and the local council, both of whom claim a path is public, whereas the owner considers it private. The dispute concerns the discrepancy between the proposed graphic base and the actual boundaries and ownership status of the paths (Art. 199 Mortgage Law).
