How the DGT's position has evolved
Current position
The use of subsidized diesel in special vehicles requires the lack of authorization to circulate on public roads or terrain, except for authorized tractors and agricultural machinery used in agricultural, livestock, or forestry activities. Its use is expressly prohibited in ordinary vehicles, such as trucks or passenger cars, regardless of their registration or circulation. In the case of forestry, tasks such as felling, logging, pruning, clearing, and fire prevention treatments are included.
The DGT's position remains constant regarding the distinction between special vehicles without authorization and ordinary vehicles. Throughout the rulings, the scope of the permitted activity for authorized tractors and agricultural machinery has been specified, extending the interpretation of forestry to specific fire prevention tasks.
Turning points
-
Establishes that if the machine is capable of being authorized as a special vehicle, it may only use subsidized diesel if it does not hold such authorization.
-
Specifies that felling, logging, pruning, clearing, and herbicide treatments to reduce fire risk are considered forestry for the use of subsidized diesel.
