Current position

Ownership of assets and the attribution of income are determined by legal ownership and the source of the income. Upon the dissolution of the community property regime (sociedad de gananciales), the allocation according to the ownership share does not generate capital gains or losses, maintaining the original values and acquisition dates. The attribution of income from economic activities falls to the person who performs the habitual, personal, and direct management of the means of production.

The DGT's position remains stable regarding the tax neutrality of the allocation of assets in the dissolution of property regimes, provided that the ownership share is respected. Consistency is observed in the attribution of income based on legal ownership and the effective exercise of the activity. No changes in doctrine are observed, but rather a constant application of criteria regarding ownership and the nature of the income.
