How the DGT's position has evolved
Current position
Scientific awards are only exempt if there is a prior resolution from the Tax Management Department declaring them as such. If there is no exemption and no transfer of intellectual property rights, the award is classified as income from economic activities. In this case, the 30 percent reduction for notoriously irregular income is applicable.
The DGT's position remains constant regarding the distinction between exemption and the classification of the award. It is confirmed that the absence of a formal exemption and the absence of a transfer of rights shifts the nature of the award from employment income to professional economic activity. The application of the reduction for irregularity remains a stable criterion for these cases.
