Current position
The obligation to file a return for Wealth Tax arises when the tax liability is payable or the value of assets and rights exceeds 2,000,000 euros. This limit is applied to the value of assets without deducting debts or charges, unlike net worth. Likewise, assets of entities with their own legal personality should not be included if one does not hold rights with economic content.
The DGT's position remains stable regarding the need for real ownership for inclusion in net worth. Recent rulings have clarified the distinction between the value of assets for the filing threshold and the concept of net worth, in addition to delimiting the lack of ownership in rights of mere expectation.
