Current position

The tax exemption on salaries and emoluments of UN specialized agencies requires proof of official status. Advisory or service contracts do not grant such status nor do they enjoy exemption under international regulations. If the work is performed from Spain, the income is subject to Personal Income Tax (IRPF) in accordance with domestic regulations and applicable double taxation treaties.

The DGT's position remains constant in requiring proof of official status to access the exemption. It has been reaffirmed that the roles of individual contractor, consultant, or advisor do not qualify as officials and, therefore, their income is subject to general taxation in Spain.

Turning points

  1. V4827-16

Establishes that the 'Individual Contractor' classification prevents the attribution of UN official status for exemption purposes.

  2. V0766-17

Specifies that remuneration for short-term consultancy services does not enjoy the exemption if they do not belong to the categories of officials communicated by the organization.
