Current position

Amounts received without consideration constitute an acquisition of goods and rights through donation or a gratuitous legal transaction inter vivos. The taxpayer is the person benefited by the operation. Management and settlement, including rates and bonuses, correspond to the Autonomous Community of residence.

The DGT's position remains constant in classifying these operations as lucrative legal transactions subject to Inheritance and Gift Tax (ISD). No changes are observed in the determination of the taxpayer or the nature of the taxable event throughout the sequence. The only relevant clarification is the requirement to prove 'animus donandi' to avoid the presumption of other natures.

Turning points

  1. V2637-24

Establishes that 'animus donandi' is not presumed and must be indisputably evident for tax liability to exist.
