How the DGT's position has evolved
Current position
The deduction for the acquisition of electric vehicles (DA 58ª LIRPF) applies exclusively to the taxpayer in whose name the vehicle is first registered in Spain. In community property regimes, the right is individual and falls upon the spouse who holds the registration, regardless of whether common funds are used. For vehicles with down payments, registration must take place before the end of the second tax period following the payment.
The DGT's position remains constant regarding the ownership of the deduction, focusing the right on the holder of the registration rather than the ownership of the funds. Clarifications have been added regarding registration deadlines in relation to down payments made following the entry into force of Royal Decree-law 5/2023.
Turning points
-
Establishes that the deduction is only applicable if the acquisition or the payment of a down payment occurs from the entry into force of Royal Decree-law 5/2023.
-
Clarifies that, in the case of down payments of at least 25%, registration must take place before the end of the second immediate tax period following the payment.
