Current position

The classification of an entrepreneur or professional depends on the organization of production means with the intent to intervene in the market, regardless of the reporting obligation under the DAC7 Directive. In operations involving digital interfaces, it is presumed that the platform acts on its own behalf if it authorizes charges or sets general conditions. Deliveries of goods from non-established entrepreneurs to the digital interface are considered exempt operations according to article 20.bis of Law 37/1992, with the right to deduction.

The DGT has moved from analyzing the nature of commercial activity on platforms (such as agriculture or logistics services) to precisely defining tax liability and the status of entrepreneur. It has clarified the presumption of acting on one's own behalf by interfaces and the application of specific exemptions for imported goods. The position has become increasingly specialized regarding the technical and regulatory interaction between the seller, the interface, and the import regime.
