How the DGT's position has evolved

Stable position High confidence 8 rulings · 2016–2025

Current position

The tax base for the incineration tax is determined by the total weight of the waste in metric tons, without allowing deductions for loss of mass, moisture, or composition. For municipal waste with prior intermediate treatment, a rate of 30 euros per metric ton is applied. The waste deposit tax must be included in the VAT (Value Added Tax) tax base for the provision of services.

The DGT's position does not show a single doctrinal evolution, but rather addresses incineration from different tax perspectives (VAT, exemptions, and tax base). A specialization is observed in the determination of the tax base based on gross weight and the distinction of rates according to the prior treatment of municipal waste.

Turning points

  1. V1042-23

Establishes that the exemption for ashes and slag does not extend to sewage sludge generated after incineration to capture pollutants.

  2. V3134-23

Specifies the conditions for the exemption of 'polyal' waste in incineration facilities, requiring that they come from recovery and not from intermediate treatment.

  3. V0973-25

Defines that the tax base is the weight in metric tons without allowing deductions for loss of mass, moisture, or density.
