Current position
To apply the ETVE (Foreign Holding Company) regime, the entity must have as its object the management and administration of securities of non-resident entities through sufficient material and personal means. Indirect ownership of holdings through sub-holdings is permitted. Dividends distributed to non-residents are not considered obtained in Spain if they derive from income exempt due to holdings in non-resident entities or permanent establishments abroad.
The DGT's position remains constant regarding the definition of operational and corporate object requirements. Rulings confirm the validity of indirect ownership of holdings and the application of the exemption in sub-holding structures, provided that the traceability of the income is maintained.
