Current position

In successive sales with a single transport abroad, the VAT exemption applies exclusively to the delivery to which the transport is effectively linked. For the first delivery to be exempt, the first seller must appear as the exporter in the SAD. If the transport is linked to a subsequent delivery, the first seller must charge the tax.

The DGT's position remains constant regarding the application of the exemption in successive sales. The criterion focuses on the linking of the transport to a specific delivery and the correct identification of the exporter in the customs documentation. No changes in doctrine are observed, but rather a reiteration of the need to prove the export through the SAD.
