How the DGT's position has evolved
Current position
The deduction requires the vehicle to belong to categories M1, L6e, L7e, L3e, L4e, or L5e and that its first registration in Spain be in the taxpayer's name. The deduction may be applied when paying at least 25% of the value as a down payment, provided that the remainder is paid and the vehicle is acquired before the end of the second subsequent tax period. The deduction base must exclude subsidies received or to be received. The application of amounts not deducted due to insufficient tax liability in subsequent tax years is not permitted.
The DGT's position remains constant regarding the application of the legal requirements of the fifty-eighth additional provision of the LIRPF (Personal Income Tax Law). Rulings have refined operational aspects such as the treatment of subsidies, the possibility of deduction through down payments, and the exclusion of vehicles from categories other than those permitted. No change in criterion is observed, but rather a delimitation of the applicable scenarios.
Turning points
-
Allows the deduction to be practiced in the tax year in which at least 25% of the value is paid as a down payment, with the remainder of the payment and acquisition occurring before the end of the second subsequent tax period.
-
Clarifies that the requirement of first registration in Spain in the taxpayer's name is not met if the vehicle was previously registered by the dealership as a demonstration vehicle.
