Current position
The transfer of ownership in judicial auctions occurs on the date of the certificate issued by the Clerk of the Administration of Justice, which includes the adjudication decree. This document constitutes the necessary title and mode for the transfer of ownership. For the purposes of determining the transfer value, the value stated in said adjudication decree shall be used.
The DGT's position has remained constant over time regarding the timing of the transfer. It has moved from focusing the accrual on the notification of the certificate (V0706-14) to defining the transfer through the conjunction of title and mode at the moment of the decree (V1329-23). Current doctrine confirms that the certificate issued by the Clerk of the Administration of Justice is the element that perfects the transfer.
