How the DGT's position has evolved
Current position
Personal Income Tax (IRPF) taxpayers applying the investment reserve in the Balearic Islands must maintain accounting records in accordance with the Commercial Code and its implementing regulations. This obligation persists from the moment profits are obtained until the investment assets remain in operation. For professional activities under the direct estimation method, this entails compliance with the registry books required by accounting regulations.
The DGT's position remains constant in requiring the application of the Commercial Code for subjects with specific accounting obligations. Rulings confirm that both civil societies with a commercial purpose and professionals under the direct estimation method must adjust their accounting to commercial regulations when tax law so requires. No changes in criterion are observed, but rather a repeated application of accounting regulations to various scenarios within the IRPF and Corporate Tax (IS) regulations.
