Professional association fees are not deductible if membership is not mandatory

The deductibility of expenses in net employment income is one of the points that attracts the most attention in the income tax return. Recently, the Dirección General de Tributos (DGT) has specified the scope of this right in relation to professional association fees.

What the DGT has ruled

The query sought to determine whether the mere exercise of professions such as architecture or engineering allowed for the deduction of their respective association fees, or whether it was necessary for membership to be legally required for the effective performance of the job.

The DGT has ruled that professional association fees are only deductible when membership is mandatory to provide labor services to the employer. For this expense to be admitted, three conditions must be met:

  • Membership must be a legal requirement for the performance of the activity.
  • The fees must correspond to the essential purposes of the association.
  • The amount must not exceed the limit of 500 euros annually.

If membership is not a legally enforceable requirement for the development of the work, the expense lacks the necessity required by the regulations to be deductible in net employment income.

What this means for you

If you are an employee, you cannot apply the deductibility of the professional association fee based solely on the fact that your profession is regulated or that membership is common in your sector. The key lies in the legal obligation to exercise your specific position.

If your contract or the regulations governing your professional activity require you to be a member in order to perform your duties, you will be able to deduct said expense within the limits established by the IRPF Law. Otherwise, the Tax Agency (Hacienda) will consider that the expense is not necessary for obtaining income, which could result in a tax assessment different from what was declared.

What you should do

It is necessary to verify whether membership is an indispensable legal requirement for the exercise of your current job position. If it is mandatory, ensure that the fee amount does not exceed 500 euros annually and that it is correctly documented to avoid discrepancies with the Tax Administration. Each professional situation must be analyzed individually to determine whether it meets the requirements of necessity and mandatory nature.
